Recommends amendments to the Work Health and Safety Bill 2011 (WHS BIll) to remove the substantial and dominant reason tests from the discrimination provisions in Part 6; and that Category 1 offences should also include “gross negligence”.
The report also includes a Coalition Senators’ Dissenting Report (Dissenting Report) which contains nine recommendations and suggests that the Committee’s report’s two recommendations “sought to open up whole new areas of law,” and should be ignored.
